Your Information. Your Rights. Our Responsibilities.
THIS NOTICE DESCRIBES HOW MEDICAL AND MENTAL HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Linardi Therapy Services is committed to protecting the privacy, confidentiality, and dignity of individuals and couples receiving mental health services.
This Notice of Privacy Practices explains how protected health information (PHI) may be used and disclosed in accordance with the Health Insurance Portability and Accountability Act (HIPAA), applicable Florida law, and other relevant confidentiality requirements.
1. Your Privacy Rights
You have the right to:
Access your health records. You may request to inspect or obtain a copy of your medical and mental health records, subject to applicable legal exceptions. We generally respond within 30 days and may charge a reasonable, legally permitted fee.
Request corrections. You may request an amendment to information you believe is inaccurate or incomplete. If we deny your request, we will provide an explanation and information about your rights.
Request confidential communications. You may ask us to communicate with you through specific methods or at alternative contact information. We will accommodate reasonable requests.
Request restrictions. You may request limits on certain uses or disclosures of your information. Although we are not required to agree to every restriction, we will comply when required by law. If you pay in full out of pocket for a service, you may request that information about that service not be disclosed to your health plan for payment or healthcare operations, unless disclosure is required by law.
Request an accounting of disclosures. You may request a record of certain disclosures of your protected health information during the preceding six years, subject to applicable exclusions.
Receive a copy of this notice. You may request a paper copy of this notice at any time, even if you previously received it electronically.
Designate a personal representative. A legally authorized representative may exercise certain privacy rights on your behalf, subject to applicable law.
File a complaint. You may submit a privacy complaint without fear of retaliation.
2. How We May Use and Disclose Your Information
Treatment
We may use or disclose your protected health information to provide, coordinate, and manage your mental health treatment.
This may include clinically appropriate communication with other healthcare professionals involved in your care, as permitted by law.
Payment
We may use or disclose necessary information to obtain payment for services, process insurance claims if applicable, manage billing, or resolve payment questions.
Healthcare Operations
We may use or disclose information for legitimate practice operations, including quality improvement, compliance activities, administrative functions, professional consultation, and practice management.
Appointment Reminders and Treatment-Related Communication
We may contact you regarding appointments, scheduling, treatment-related matters, or other communications permitted by law.
Uses or Disclosures Required or Permitted by Law
Under certain circumstances, information may be disclosed without your authorization when required or permitted by applicable law, including:
-
Mandatory reporting of suspected abuse or neglect
-
Situations involving serious threats to health or safety
-
Certain judicial or administrative proceedings
-
Authorized health oversight activities
-
Public health requirements
-
Other legally authorized disclosures
-
We will apply applicable federal and Florida confidentiality protections when evaluating such requests.
3. Psychotherapy Notes
Psychotherapy notes, as specifically defined by HIPAA, receive additional privacy protections.
These are notes maintained separately from the clinical record that document or analyze the contents of counseling sessions.
Except for limited circumstances permitted or required by law, your written authorization is required before psychotherapy notes may be used or disclosed.
Routine clinical progress notes and treatment records are not necessarily psychotherapy notes under HIPAA.
4. Substance Use Disorder Treatment Records
Certain substance use disorder treatment records are subject to additional confidentiality requirements under federal law, including 42 CFR Part 2.
Where those requirements apply, Linardi Therapy Services will follow the applicable rules governing consent, disclosure, redisclosure, and use of such records in legal proceedings.
Part 2 records generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient without the specific consent or legal authorization required by Part 2.
Additional Part 2-specific notice language, including rules concerning consent, fundraising, and permitted redisclosures, will be incorporated as applicable to the records maintained or received by the practice.
5. Individual, Couples, and Family Therapy Confidentiality
Linardi Therapy Services provides individual therapy, couples counseling, and related mental health services.
Confidentiality in couples or family therapy may involve multiple participants and special considerations regarding shared treatment records, access, authorizations, and communications.
These matters will be addressed through the practice's informed consent and applicable confidentiality policies.
Participation in couples or family therapy does not automatically establish identical rights to every record or communication for every participant.
6. Telehealth and Electronic Communication
Linardi Therapy Services offers telehealth services to eligible clients located in Florida.
We use administrative, technical, and physical safeguards designed to protect confidential information, including information transmitted or stored electronically.
Although reasonable precautions are taken, electronic communication carries inherent privacy and security risks.
Clients should use practice-designated secure communication methods for sensitive clinical information whenever possible.
7. Uses and Disclosures Requiring Authorization
We generally obtain your written authorization before using or disclosing protected health information for purposes requiring authorization under HIPAA or other applicable laws.
Examples include:
-
Most uses or disclosures of psychotherapy notes
-
Certain marketing activities
-
The sale of protected health information
-
Other uses or disclosures not otherwise permitted or required by law
You may revoke an authorization in writing, except to the extent that action has already been taken in reliance on it.
